PROPERTY TAX EXEMPTION DEADLINE FOR UNOCCUPIED HOMES

The General Assembly passed legislation in 2009 to give builder/developers an exemption on property tax for newly constructed and yet unoccupied detached single family homes that received their certificate of occupancy (CO) after 2006. Effective in July 1, 2009 a newly constructed home that remains unoccupied will not have the improvement (home) taxed until it is occupied, or the home reaches the sixth December 31 renewal date after receiving its Certificate of Occupancy (CO).

It is imperative and financially rewarding for every builder who is qualified for the exemption to meet the specified deadline - January 31. Failure to meet this deadline will result in a loss of the property tax exemption for the 2010 tax year! Information on how to secure and maintain the property tax exemption is detailed below.

    Obtaining & Maintaining Exemption:

    A. Homes Receiving CO in 2007- 2008 - Builder should have file exemption form with county assessor by September 30, 2009 for the 2009 tax year exemption. If this was not done, the tax exemption form should be filed by January 31, 2010.

For those who got their tax exemption in on time in 2009, you must recertify each year beginning on January 31, 2010 that the house remains unoccupied to maintain the tax exemption.

    B. Homes Receiving CO in 2009 forward - If builder gets a CO, he has to notify assessor within 30 days of receiving a CO, or by January 31, 2010 that the house is unoccupied. Going forward, if house sale is not pending, it would seem prudent to file exemption form when CO issued just to be safe.

    C. The County Assessors have developed a form to claim the tax exemption and annual extension. However, the form may vary slightly from county to county. To protect your legal rights the application should be notarized.

2009 BUILDER AND ASSOCIATE MEMBERS OF THE YEAR

Each year the Home Builders Association of Greater Columbia (HBAGC) holds its annual Holiday Ball in Columbia.  It’s an evening of fun and celebration, and recognition of those who have helped the home building industry throughout the year.

Prior to the Holiday Ball, the HBAGC membership votes for their choice of nominees for the Byron Crosthwaite Builder Member of the Year and the Award William H. Peters Award recognizing the Associate member of the year.

The 2009 Byron Crosthwaite Builder Member of the Year is Barry Davis, CMB of Barry Davis Homes, Inc.  Barry has been a member of the association since 1989.   He has served on the HBA Board of Directors since 2006, serving this year as President of the association.  Davis has presented homes in many Parade of Homes and Tour of Homes events over the years.  He is a member of the Builder/REALTOR Joint Legislative Committee and the HBA Political Education Committee.  Davis attends many HBA meetings as well as the HBA of South Carolina and National Association of Home Builders annual conventions.  In addition to his duties as President of the association this year Barry also attained the Certified Master Builder designation from the HBA of South Carolina and joined the Green Building Council of Greater Columbia.

Barry was born in Charleston, SC and raised from the age of three in Columbia, SC, where he attended A. C. Flora High School.  He then attended the University of South Carolina for a few years and then entered the U.S. Navy Reserves.  Upon completion of his time in the Reserves, he continued his education at what is now Charleston Southern University where he attained a B.S. in Marketing with a minor in Economics.  After college Barry worked as a buyer for Rockwell International, Materials Manager for Owens Steel, and with Cooper Air Tools. Today, he is owner and president of The Barry Davis Company, Inc.  He and his wife, Earline, have two children, Alan S. Davis, a Civil Engineer in Columbia, and Craig C. Davis, Band Director at York High School.  Barry and Earline are members of Lexington United Methodist Church.

The Home Builders Association also gives an award for Associate Member of the Year.  This award, named after William H. “Billy” Peters, recognizes a member who represents the association in an outstanding manner in the business community, and who devotes tireless service to the improvement of the association.  The 2009 recipient of the William H. Peters Award recognizing Associate Member of the Year is James W. “Jimmy” Derrick of Coldwell Banker United REALTORS.  Jimmy has been a member of the HBA since 1986.  He regularly attends local and state HBA including Sales & Marketing Council of Columbia meetings.  Throughout his many years involved with the HBAGC he has shared his time and talents with the association and fellow members.  Perhaps his greatest contribution to our group, and to Columbia on the whole, is his work helping charitable organizations including the HBA Charitable Foundation.  He uses his great personality and skills as an auctioneer to encourage others to dig deep and help those in need.  He could very easily be called The Voice of Charitable Giving in Columbia.  We appreciate his work in this area and with our association.

The Gordon A. Harrison Award is given each year to an outstanding home builder in the spirit of the man it is named after.  Harrison is remembered for his high personal character and integrity, and his commitment to helping others.  The recipient of the 2009 Gordon A. Harrison Award is John A. Zeigler, III of Zeigler Home Builders.  John has been a Builder Member of the HBAGC since 1991 and has been on the HBA Board of Directors since 1998. He served as President of the Association in 2005 and was awarded the Byron Crosthwaite Builder Member of the Year for the same year.  John as presented homes in many Parade of Homes and Tour of Homes events in Columbia, which has helped earn the reputation as a high-quality custom homebuilder.  He is active in the HBAGC having served as Chairman of the Columbia Remodelers council in 1997, as a current member of the Green Building Council of Greater Columbia, and attending many local, state and national HBA meetings.

Zeigler has over 30 years of construction experience in a custom cabinet shop and experience in wholesale and retail building material sales.  He has a degree in carpentry technology from Midlands Technical College.  He is married to wife Cherie and attends LongCreek Presbyterian Church.  He has three daughters, Lauren Zeigler Brooks, and Chelsey and Daytona Zeigler.

The association also awarded Civil Engineering of Columbia, Inc. as Corporate Member of the Year.  The people that make up Civil Engineering are active in the HBAGC, the Land Development Council and the Green Building Council of Greater Columbia.  They regularly attend meetings and, furthermore, lend their expertise to help the association and fellow members whenever possible.  Civil Engineering of Columbia, Inc. also contributes financially to HBA events and meetings through sponsorships.  We are proud to name them the Corporate Member of the Year.

The Home Builders Association of Greater Columbia would like to commend the award winners on their hard work throughout the year.  They have not only served the home building industry well, but the Columbia community and the entire state have benefited from their dedication and work.

HBA of GREATER COLUMBIA MASTER BUILDERS

The Home Builders Association of South Carolina began the Certified Master Builder Designation program in 2005.  The Master Builder designation is assurance that the builder has a level of professionalism together with the knowledge and skill to meet customer expectations and ensure homeowner satisfaction.

Certified Master Builders must complete rigorous training and education requirements, satisfy specific licensing and insurance requirements, have completed at least three major construction projects in the past two years, and are recommended by their peers.

Ten members of the HBA of Greater Columbia are currently Certified Master Builders:

Carl Berry, B & B Master Builders, Inc.

Keith Berry, B & B Master Builders, Inc.

    Thom Chumney, Mungo Construction, LLC

    Chris Condon, Mungo Homes, Inc.

Barry Davis, The Barry Davis Company, Inc.

James G. Graves, Colony Builders of Carolina

Matt Hancock, CGP, CAASH, CAPS, GMB, CGB, Hancock Construction, LLC

    Ken King, P & K Construction, Inc.

    Steven Mungo, Mungo Homes, Inc.

Tony Thompson, CGR, CAPS, CGP, Remodeling Services Unlimited

Although South Carolina has one of the most rigorous licensing requirements in the country, the Home Builders Association of South Carolina has begun this program to allow builders to go up even higher.

Congratulations to these members on their accomplishment.  We hope to see more Master Builders in our ranks soon.
